Important Notice

These Terms & Conditions constitute a legally binding agreement between you ("Guest" / "Customer" / "User") and Danma Retreat Pvt. Ltd. ("Company" / "We" / "Us"), a company incorporated under the Companies Act, 2013, having its registered office at Village Pangot, Near Naini Lake, Nainital, Uttarakhand 263001, India. By accessing our website or availing our services, you acknowledge that you have read, understood, and agree to be bound by these terms.

General Terms

1.1   Danma Retreat Pvt. Ltd. is a hospitality and adventure tourism company registered under the Companies Act, 2013 (CIN to be updated), operating retreat, camping, and adventure tourism services from its location in Nainital, Uttarakhand, India.

1.2   These Terms & Conditions apply to all guests, visitors, and users of our website (www.danmaretreat.com), mobile applications, and on-premise services including accommodation, restaurant, adventure activities, and any ancillary services.

1.3   The Company reserves the right to modify, update, or amend these Terms at any time without prior notice. Continued use of our services after such changes constitutes your acceptance of the modified terms.

1.4   By making a booking, you confirm that you are at least 18 years of age and legally capable of entering into a binding contract as per the Indian Contract Act, 1872.

1.5   Any services offered by third-party operators through Danma Retreat are subject to the respective third party's own terms and conditions. The Company shall not be liable for third-party services.

Booking & Reservations

2.1   All bookings are subject to availability and shall be confirmed only upon receipt of the applicable advance payment and issuance of a Booking Confirmation Email containing the Booking ID, accommodation details, and payment summary.

2.2   The guest must provide accurate personal information including full name, valid email address, phone number, and a government-issued ID (Aadhaar Card, Passport, Driving Licence, or Voter ID) at the time of booking.

2.3   Room/camp allocation is at the sole discretion of the management. While every effort will be made to honour specific room requests, the Company does not guarantee a particular room or camp type.

2.4   A minimum advance payment of 30% of the total booking amount is required to confirm the reservation. The remaining balance must be settled at or before check-in.

2.5   Group bookings (5 or more rooms) are subject to separate group booking terms and may require a higher advance payment percentage.

2.6   Booking modifications (date change, room upgrade) are subject to availability and may involve additional charges or fare differences.

Check-in & Check-out Policy

3.1   Standard Check-in Time: 2:00 PM (IST). Standard Check-out Time: 11:00 AM (IST).

3.2   Early check-in is subject to room availability and may attract an additional charge of up to 50% of the daily room rate.

3.3   Late check-out beyond 11:00 AM may be granted subject to availability. Late check-out until 2:00 PM may incur a charge of 50% of the daily room rate. Check-out after 2:00 PM will be charged as an additional night.

3.4   At the time of check-in, guests are required to present a valid government-issued photo ID (Aadhaar Card, Passport, Driving Licence, or Voter ID) as mandated by the local police and administration.

3.5   Foreign nationals must present a valid passport and visa as per the Foreigners Registration Act, 1939, and the Registration of Foreigners Rules, 1992. Their details will be reported to the Foreigners Regional Registration Office (FRRO) as required by law.

3.6   The Company reserves the right to refuse check-in if the guest fails to provide valid identification or if there is a discrepancy between the booking details and the identification provided.

Payment Terms

4.1   All prices are quoted in Indian Rupees (₹/INR) and are inclusive of applicable Goods and Services Tax (GST) as per the CGST Act, 2017, unless otherwise stated.

4.2   We accept payments via Cash, Debit/Credit Cards (Visa, MasterCard, RuPay), UPI (Google Pay, PhonePe, Paytm), Net Banking, and Bank Transfer (NEFT/RTGS/IMPS).

4.3   All online payments are processed through PCI-DSS compliant payment gateways. The Company does not store credit/debit card details on its servers.

4.4   GST will be charged at the prevailing rate applicable to the accommodation tariff slab as defined under SAC code 9963 (Accommodation Services):

4.5   Invoices with GSTIN details shall be provided for all transactions. Guests requiring GST-compliant invoices for business purposes must provide their GSTIN at the time of check-in.

4.6   Any dispute regarding payment must be raised within 7 days of the transaction date by emailing info@danmaretreat.com.

Adventure Activities & Safety

5.1   All participants in adventure activities (rock climbing, zip-lining, river rafting, trekking, etc.) are required to sign a Liability Waiver and Assumption of Risk Form prior to participation.

5.2   Participation in adventure activities is entirely at the guest's own risk. The Company, its employees, and instructors shall not be held liable for any injury, illness, or death arising during or as a result of participation in any adventure activity, except in cases of proven gross negligence.

5.3   Guests with pre-existing medical conditions (heart disease, epilepsy, respiratory disorders, pregnancy, etc.) must disclose the same and obtain written medical clearance before participating in any adventure activity.

5.4   The Company reserves the right to cancel, modify, or suspend any activity due to adverse weather conditions, safety concerns, insufficient participation, or any force majeure event as defined under Section 56 of the Indian Contract Act, 1872.

5.5   Guests must follow all safety instructions given by activity instructors and guides. Non-compliance with safety protocols may result in removal from the activity without refund.

5.6   Minimum age requirements apply for certain activities. Children under 12 years must be accompanied by a parent or guardian at all times during activity participation.

Guest Code of Conduct

6.1   Guests are expected to maintain decorum, respect other guests and staff, and act in a manner that does not disturb the peace and privacy of fellow guests.

6.2   Prohibited Activities: Smoking in non-designated areas, consumption of illegal drugs or substances, carrying firearms or weapons, creating excessive noise (especially between 10:00 PM and 7:00 AM), littering on the premises or in surrounding natural areas, and any form of vandalism or damage to property.

6.3   Guests shall be held financially responsible for any damage caused to the Company's property (rooms, furniture, equipment, natural environment) during their stay. Repair or replacement costs will be charged to the guest's account.

6.4   The Company reserves the right to evict any guest who violates the Code of Conduct, engages in illegal activity, or behaves in a manner that threatens the safety or comfort of others, without any refund.

6.5   As the retreat is located in an ecologically sensitive area of Uttarakhand, guests are expected to follow eco-friendly practices. The use of single-use plastics is strictly prohibited on the premises in compliance with the Plastic Waste Management Rules, 2016 (as amended).

6.6   Pets are not permitted on the premises unless prior written approval has been obtained from the management.

Limitation of Liability

7.1   The Company shall not be liable for any loss, theft, or damage to the guest's personal belongings, valuables, or vehicles during the stay. Guests are advised to use the in-room lockers/safes provided where available.

7.2   The Company's total liability under any claim arising from or in connection with the guest's stay shall not exceed the total amount paid by the guest for the specific booking in dispute.

7.3   The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunity.

7.4   The Company shall not be responsible for any disruption of services caused by events beyond its reasonable control, including but not limited to natural disasters, epidemics, government orders, power outages, communication failures, strikes, or any other force majeure event.

Intellectual Property

8.1   All content on the website including text, graphics, logos, images, audio/video clips, and software is the intellectual property of Danma Retreat Pvt. Ltd. and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.

8.2   No content from this website may be reproduced, distributed, modified, or used for commercial purposes without the prior written consent of the Company.

Governing Law & Dispute Resolution

9.1   These Terms & Conditions shall be governed by and construed in accordance with the laws of India.

9.2   Any dispute arising out of or in connection with these terms shall first be attempted to be resolved amicably through mediation. If unresolved within 30 days, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.

9.3   The arbitration shall be conducted by a sole arbitrator mutually appointed by both parties. The seat of arbitration shall be Nainital, Uttarakhand, and the language of arbitration shall be English.

9.4   Subject to the above arbitration clause, the courts at Nainital, Uttarakhand shall have exclusive jurisdiction over any legal proceedings.

We shall acknowledge your grievance within 48 hours and endeavour to resolve it within 30 days as per the Consumer Protection Act, 2019.
